Lakhimpur Kheri violence case: Supreme Court extends interim bail of Ashish Mishra
The Supreme Court on Monday extended the interim bail of Ashish Mishra, son of Union Minister Ajay Kumar Mishra, in the 2021 Lakhimpur Kheri violence case, which claimed eight lives.
A bench comprising Justice Surya Kant and Justice K V Viswanathan while extending the interim bail directed SC registry to obtain a report from the trial court on the progress of the case and adjourned the matter.
The case pertains to an incident of violence on October 3, 2021, in which eight people, including four farmers, were killed in Tikunia in the Lakhimpur Kheri district of Uttar Pradesh.
The Apex Court in September, 2023, had relaxed the interim bail conditions imposed by the trial court on January 25 last year in which Mishra was directed not to stay either in Uttar Pradesh or in Delhi during the period.
After hearing Mishra’s plea that his mother was admitted to the Ram Manohar Lohia (RML) Hospital in Delhi, the Apex Court allowed him to visit Delhi.
On December 6 last year, the trial court had framed charges against Mishra and 12 others for the alleged offences of murder, criminal conspiracy, and under other penal laws in the case of the farmers’ deaths, paving the way for the trial to start.
The Top Court had relaxed the conditions of Mishra’s bail imposed by the Trial Court on humanitarian grounds as he further stated that his daughter needed treatment for certain deformities in her legs.
The Apex Court, however, directed Mishra not to participate in any public function in Delhi and address the media about the case, till the matter is sub-judice. The Court also directed Mishra not to enter Uttar Pradesh except to attend the trial.
The investigation of the case was going on under the Supreme Court-appointed Special Investigating Team (SIT) under the supervision of Justice Rakesh Kumar Jain, a former judge of the Punjab and Haryana High Court.
On September 18, 2023, the Apex court relieved the SIT, saying it had completed its probe and submitted a chargesheet in the trial court. Earlier on July 11 also, the top court had extended Mishra’s interim bail.
