SC dismisses plea against PM Cares Fund
New Delhi/UNI: The Supreme Court on Monday dismissed a plea challenging the PM Cares fund, after describing it as 'totally misconceived.'
A bench of the Apex Court, headed by CJI S A Bobde, was hearing the plea filed by Adv ML Sharma challenging the foundation of PM Cares, a fund created especially to pool in monetary resources for COVID-19.
In the plea, Sharma argued that the fund has been created without following the schemes enumerated under Articles 266 and 267 (which deal with the contingency and the Consolidated Funds of India) of the Constitution.
While terming it as a 'misconceived petition,' the CJI said it is not about the collection of revenue.
The bench also warned the petitioner and said,"we will impose cost on you."
The plea had made all the trustees of the fund including Prime Minister Narendra Modi, Home Minister Amit Shah and Finance Minister Nirmala Sitharaman parties to it.
