MVA govt can't be restored in Maharashtra since Uddhav Thackeray resigned: Supreme Court

Mumbai/IBNS: The Supreme Court on Thursday ruled the Maha Vikas Aghadi government can't be restored in Maharashtra as Uddhav Thackeray had resigned as the Chief Minister voluntarily, media reports said.

The court said the government can't be reinstalled as Uddhav resigned before the floor test.

Besides, the top court has also slammed the Governor for appointing the whip of Eknath Shinde group of Shiv Sena saying such power rests with political parties.

"Floor test cannot be used to resolve internal party disputes," said the court.

The court added the Governor was right in calling the Shinde camp to form the government as Uddhav had resigned.

After the BJP emerged as the single largest party but failed to get the majority, its ally Shiv Sena demanded the Chief Minister's post, which the saffron party was not ready to bargain for.

Later, the Shiv Sena joined hands with the arch-rivals Nationalist Congress Party and Congress to form a three-party coalition government in Maharashtra.

A rebellion by 40 Sena MLAs including Shinde led to the collapse of the three-party alliance government in June last year, paving way for the current Chief Minister to assume the top post allying with the BJP.
