Bhima-Koregaon case: NIA seeks urgent hearing on Sudha Bharadwaj's bail

New Delhi/UNI: The National Investigation Agency (NIA) on Monday moved the Supreme Court for an urgent listing and hearing of its plea against default bail granted by high court to lawyer-activist, Sudha Bharadwaj in the 2018 Bhima Koregaon – Elgar Parishad alleged violence case.

The plea was against the Bombay High Court’s order granting the default bail to Bharadwaj on Dec 1.

Solicitor General Tushar Mehta appearing for the NIA, mentioned the matter before a three-judge bench headed by Chief Justice NV Ramana.

Mehta said the order will come into effect from Wednesday, so the urgent hearing matters.

CJI Ramama said: "We will try to see it tomorrow (Tuesday)."

The NIA on Dec 2 approached the Supreme Court challenging the Bombay High Court's order.

Bharadwaj was taken into custody by Pune police on Oct 27, 2018.

She was remanded to police custody for 10 days by Additional Sessions Judge, Pune, K.D. Vadane.

On Nov 22, the public prosecutor filed a report seeking extension of period for investigation.

On Nov 26, Bharadwaj filed for bail under the CrPC as the 90-day period from the date of her arrest and production before the magistrate had expired.

Judge Wadane, however, extended the period of detention by 90 days.

The charge sheet was filed on Feb 21, 2019.
