Six-months 'cooling off' period can be waived in divorce cases: SC

New Delhi, Sept 12 (IBNS): The Supreme Court on Tuesday ruled that the 'six-months cooling off period' in divorce cases can be waived off and Hindu married couples can straightaway get separation order with mutual consent.

The apex court on Tuesday held that the 'cooling off period' is no longer mandatory.

This means that Hindu married couples will not require to wait six months for separation orders if they part ways based on mutual consent.

However, the waiving will be applicable only if the parties had already lived separately for at least a year.

The bench said the period of six months can be waived off if conciliation fails.

Added to that, both parties will have to resolve differences relating to alimony, custody of child or any other pending issues between them.
