Delhi High Court dismisses CBI plea in INX Media case

New Delhi/UNI: The Delhi High Court on Wednesday dismissed the petition of Central Bureau of Investigation (CBI), challenging the special court's order that permitted former Union Minister P Chidambaram and other accused to see documents related to the investigation in the INX Media case.

Justice Mukta Gupta, referring to various sections of CrPC and the recent Supreme Court judgements, said that the accused have the right to see and obtain a photocopy of documents related to the investigation. They cannot be denied this right.

The High Court had reserved its verdict on Aug 27, after completing the hearing on CBI's plea.

The CBI special court had on Mar 5 allowed Chidambaram, his MP son Karti Chidambaram and other accused to obtain a photocopy of the evidence gathered by CBI during the investigation.

The national agency had argued during the hearing in the High Court that the evidence may be tampered with by the accused while showing the documents during the investigation. The CBI said this was a big case of corruption.

The case related to allegations of the former Union Finance Minister misusing his position during the UPA government, giving undue benefit of crores of rupees to INX Media and INX News Private Limited Company.

Karti and others are accused in the same case.

CBI had filed an FIR on May 15, 2017 under various Sections of the Prevention of Corruption Act 1988, besides Sections 120-B, 420, 468 and 471 of IPC.
