CBI court gives bail to accused in coal scam

| @indiablooms | Dec 19, 2021, at 01:29 am

New Delhi/UNI: A Delhi Central Bureau of Investigation's Special Court has granted bail to all the accused allegedly involved in a coal block case related to M/s Sunil Hi-tech Engineers Ltd.

It was alleged that the company was not fulfilling the technical evaluation as it did not have any mining experience in an open cast or underground mining.

But the Tender Committee consisting of the then Chairman, then Managing Director and the consultant treated Sunil Hi-Tech Engineering Ltd as technically qualified and their price bid was opened.

The Central Bureau of Investigation (CBI) filed a charge sheet before the Special CBI court under sections 120B and 420 of the Indian Penal Code and also the Prevention of Corruption Act, 1988.

Based on the charge sheet and hearing the submissions on behalf of the Prosecution, CBI Special Court issued summons to all the accused persons for appearing before the Court.

The accused argued that the CBI had filed the charge sheet without making arrests and the court had issued the summons. The counsel submitted that the custody of the accused was not required as they have cooperated with the investigation and appeared before the investigation officer whenever called.

Special CBI Judge Arun Bhardwaj after hearing arguments on behalf of the prosecution and defence counsels granted bail to the accused persons on condition that they furnish personal bond and surety bond for a sum of Rs 200,000.

Further, the court said that they will not try to influence prosecution witnesses or tamper with the evidence and take permission before leaving the country.
