Calcutta HC judge sentences CJI, 7 other SC judges to 5 years in prison

Kolkata, May 8 (IBNS): Calcutta High Court judge Chinnaswamy Swaminathan Karnan, who is currently facing contempt of court proceedings for defying orders of the Supreme Court, on Monday awarded five years rigorous imprisonment and a fine of Rs 1 lakh each to Chief Justice of India J S Khehar and seven other judges of the Supreme Court,

Justice Karnan, who was earlier asked to undergo a medical test to ascertain his mental state, has made the order after finding the eight Supreme Court judges guilty under section 3, Sub-sections (1), (m), (r) and (u) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989.

According to the order, served by Justice Karnan, Chief Justice of India Jagdish Singh Khehar and seven other Supreme Court judges, including Justice Dipak Misra, Justice J. Chelameswar, Justice Ranjan Gogoi, Justice Madan B. Lokur, Justice Pinaki Chandra Ghose, Justice Kurian Joseph and Justice Mrs. R. Banumathi, jointly committed the offences punishable under the SC/ST Atrocities Act of 1989 and amended Act of 2015.

Justice Karnan has directed Delhi Police Commissioner to execute the order immediately and also ordered the eight Supreme Court judges to surrender their passports before New Delhi Police.

Justice Karnan said that he pronounced the order in a makeshift court at his residence in Kolkata's New Town area.

Justice C S Karnan had earlier refused to undergo a medical examination as ordered by the Supreme Court, saying he is "normal and has a stable mind".

Justice Karnan and the Supreme Court went on a collision course when on Jan 23 he wrote a letter to Prime Minister Narendra Modi with the names of 20 "corrupt judges" and three senior law officials.
