AAP MLA Somnath Bharti gets 2 yrs jail for assaulting AIIMS security staff

New Delhi/IBNS: Aam Aadmi Party MLA Somnath Bharti has been sentenced to two years imprisonment along with a fine of Rs 1 lakh by a court in Delhi for beating up the AIIMS security staff, said media reports.

Additional Chief Metropolitan Magistrate Ravindra Kumar Pandey, who gave the judgment, allowed the AAP leader to file an appeal before the high court against the conviction.

Bharti was granted to file an appeal before the high court.

In 2016, Bharti brought down the fence in All India Institute of Medical Sciences (AIIMS) in Delhi with a JCB operator, the media reports said.

The court held Somnath Bharti guilty under  the Indian Penal Code (IPC), including under the Indian Penal Code (IPC), including under sections 323 (voluntarily causing hurt), 353 (assault or use of criminal force to deter public servant from discharge of his duty) and 147 (rioting); section 3 (mischief causing damage to public property) of the Prevention of Damage to Public Property Act, sections 323 (voluntarily causing hurt), 353 (assault or use of criminal force to deter public servant from discharge of his duty) and 147 (rioting), media reports informed.

Bharti's co-accused and associates in the case have been acquitted due to lack of evidence.

The case was registered based on a complaint filed by RS Rawat, Chief Security Officer, AIIMS.

In his defence Bharati had said the police officials and other witnesses had given statements against him to frame him in the case.
