Android abuse: Big setback for Google as NCLAT refuses interim stay on CCI order
New Delhi: The National Company Appellate Tribunal (NCLAT) rejected Google’s plea seeking an interim stay on CCI’s order directing the US-based tech giant to change its business model in India, media reports said.
However, NCLAT offered some relief to Google some relief on the monetary front and asked it to deposit at least 10 percent of the fine imposed by the CCI.
In October, the CCI fined Google Rs 1,330 crore for exploiting its dominant position in markets such as online search and the Android app store and asked it to do away with the restrictions on phone-makers pertaining to preinstalling apps.
Google has approached the tribunal seeking to have CCI’s order quashed.
Google alleged that CCI's investigation unit "copy-pasted extensively from a European Commission decision, deploying evidence from Europe that was not examined in India," Reuters reported.
NCLAT noted that Google approached the tribunal only a day before the 60-day time limit to comply with the CCI order was to end and that the tribunal did not see any urgency for contention.
It scheduled the next hearing on the matter for April 3.
