Gujarat Rajya Sabha bypoll: SC seeks urgent response from ECI
New Delhi, Jun 19 (UNI) Supreme Court on Wednesday issued notice to the Election Commission of India (ECI) on a petition seeking its immediate intervention and a direction to conduct simultaneous polls for two Rajya Sabha seats from Gujarat.
The SC issued the notice after hearing the petition filed by the Congress leader, Pareshbhai Dhanani.
After hearing the petition filed by Pareshbhai Dhanani, a vacation bench of the apex court, headed by Justice Deepak Gupta, issued notice to the ECI and sought it's response on hearing the petition of Congress leader, Dhanani, and posted the matter for further hearing for Tuesday.
"We issue notice to the respondent, the ECI on the petition of Pareshbhai Dhanani. The ECI has to file a response by Monday. We will hear the matter again on Tuesday, June 25," the bench of the top court said.
The top court said that the issue raised in the petition needed to be adjudicated and asked the ECI to file a detailed affidavit by Monday.
Gujarat’s Congress leader, Dhanani, had moved the Supreme Court on Tuesday against the decision of the ECI to hold separate bypolls on two Rajya Sabha seats which fell vacant after the elections of BJP President, Amit Shah and Smriti Irani to the Lok Sabha.
Senior Supreme Court advocate and Member of Parliament (MP) Vivek Tankha, appearing for Pareshbhai Dhanani, had mentioned the matter on Tuesday seeking an urgent hearing in the case, to which the top court on Tuesday had said, it would hear the matter on Wednesday.
“Such manoeuvring" by the BJP and the ECI to suit their political agenda actually amounted to a "death knell to the democracy," Gujarat Congress leader, Pareshbhai Dhanani claimed in his petition and sought an urgent hearing into his case.
