SC refuses to transfer AIADMK MLAs' disqualification case
New Delhi, Jun 27 (IBNS): The Supreme Court on Wednesday refused to transfer from the Madras High Court the case pertaining to the disqualification of 18 AIADMK MLAs, media reports said.
A two-member vacation bench of justices Arun Mishra and SK Kaul, however, appointed Justice M Sathyanarayanan as the third judge in the Madras HC, to decide on the petition filed by 18 AIADMK MLAs against their disqualification.
The MLAs had sought transfer of their case from the Madras High Court to the Supreme Court after the split verdict by the high court on June 14.
While the Chief Justice of Madras HC Indira Banerjee upheld the disqualification order passed by Tamil Nadu Assembly Speaker P Dhanapal, Justice M Sundar quashed the speaker’s order for disqualification.
Justice Banerjee said in view of the contradicting judgements, the case will now be transferred to a different bench. The majority view would be considered the judgement.
