CJI bench to hear Judge Loya case today
New Delhi, Jan 22 (IBNS): A Supreme Court bench headed by Chief Justice of India Dipak Misra, will hear two PILs on a probe in an alleged mysterious death of Judge BH Loya, who was investigating the Sohrabuddin fake encounter case in which BJP President Amit Shah was one of the accused, media reports said.
The hearing is taking place after an unprecedented press conference held on Jan 12 by the four senior Supreme Court judges, who had revolted against the CJI over assigning of cases.
At the time Loya had died, he was hearing the Sohrabuddin fake encounter case.
Later Shah was acquitted of all charges.
Four senior judges- Justices Jasti Chelameswar, Ranjan Gogoi, Madan B Lokur and Kurian Joseph- alleged that cases with far reaching consequences were assigned to selective judges.
Justice Chelameswar, who represented the four judges in front of the media, said they had approached the CJI with a letter but failed to convince him.
The press meet thus was the last option left for the judges, Justice Chelameswar said.
In the last week, the CJI met the four rebel judges three times to settle the dispute.
In the first sign of communication after a virtual rebellion in the top judiciary, Chief Justice of India Dipak Misra on Tuesday met with the four dissenting judges even as the Supreme Court announced composition of a five-judge Constitution bench for hearing of several important cases, excluding the quartet, media reports said.
According to reports, the CJI met the rebel judges on Tuesday afternoon and Thursday as well.
Earlier on Tuesday, Attorney General KK Venugopal said that the judicial crisis hasn’t been resolved.
His statement comes contradictory as on Monday he told media that the rift between four senior Supreme Court judges and the Chief Justice of India had been settled.
The four judges took up their respective business on Monday after the weekend when they publicly criticised the CJI.
