Uttarakhand issue : HC again raps Centre
“The highest body, government of India is involved…The petitioners apprehension is that Central would revoke the President’s rule before we pass our final order…More than anger we are pained…how can you play with the court…this is travesty of justice,” the bench of Chief Justice K M Joseph and Justice V K Bist said.
“Ask if you (central government) can wait for 10 days,” the court said.
The bench was hearing arguments on ousted Chief Minister Harish Rawat’s petition challenging imposition of President’s Rule and related petitions.
The observations came as Rawat in his application said that he has apprehension that Central government could revoke President’s rule, before the court passes the order and that the High Court should pass an interim order restraining the Central government to revoke President rule before the final order.
"Why don't you give a definite instruction that you won't revoke the President's Rule for a week? Tomorrow, if you revoke President's Rule and invite somebody, it will be a travesty of justice," the court said.
" How can you be playing with the court?" the court said in remarks that echo its sentiment on Wednesday when it ruled that even the President of India can "go wrong" in such matters.
