Supreme Court doesn't entertain petition against BJP leader Suvendu Adhikari
New Delhi/UNI: The Supreme Court on Monday refused to interfere with the order of a Division Bench of the Calcutta High Court refusing to entertain a petition against a single judge decision staying criminal proceedings initiated against BJP MLA and Leader of the Opposition in West Bengal, Suvendu Adhikari.
"We will not entertain this plea for the simple reason that the order of the single judge was challenged under Article 136 before us. We have dealt with the challenge on merits," a bench of the Supreme Court led by Justice D.Y. Chandrachud said.
Senior advocate Maneka Guruswamy, petitioner for West Bengal, said there were two issues in the case.
The Supreme Court was hearing the West Bengal government’s petition challenging the Calcutta High Court’s order protecting Adhikari from any coercive action in criminal cases registered against him by the state police.
The apex court while dismissing the petition noted that the parties will be governed by the order of December 13, 2021 passed in a Special Leave Petition by the single judge.
In another development, the Supreme Court adjourned Adhikari's plea seeking transfer of Chief Minister Mamata Banerjee's election petition from the Calcutta High Court.
