Supreme Court admits Armymen plea against FIR against them in AFSPA areas

New Delhi, Aug 14 (IBNS) : More than 300 soldiers on Tuesday moved the Supreme Court challenging registration of FIRs against them for operations in areas where the Armed Forces (Special Powers) Act is in force, reports said.

The Supreme Court admitted the petition and  agreed to hear it on August 20.

A bench comprising Chief Justice Dipak Misra and Justice A M Khanwilkar considered the submissions of the soldiers' lawyer Aishwaryia Bhati that Army personnel are being prosecuted for performing duties in disturbed areas.

Bhati told the media that the petition claims that exposing soldiers to CBI and police prosecution for exigencies during operational encounters against insurgents will endanger national security.

The plea said the registration of FIR and prosecution of Army personnel, as done by some organisations, was against the provisions of AFSPA as they grant immunity to them against the prosecution for actions performed during official duties.

Recently, the top court had passed an order directing the national investigating agency to register case and prosecute armed forces personnel and policemen for
alleged extra-judicial killings while operating in disturbed .areas of Manipur in last two decades.
