Sexual harassment charge not attracted when woman wears 'sexually provocative dresses': Kerala court

Thiruvananthapuram/IBNS: A district sessions court in Kerala's Kozhikode has observed sexual harassment charge will not be prima facie stand when the complainant woman wears "sexually provocative dresses", media reports said.

The court made the observation while granting bail to writer and social activist Civic Chandran in a sexual harassment case.

The accused, who had furnished photographs of the complainant, was granted an anticipatory bail Aug 12.

In reference to the photographs, the court said, "It would reveal that the de facto complainant is herself exposing to dresses which are having some sexual provocative one. So, Section 354A will not prima facie stand against the accused."

"In order to attract this Section, there must be a physical contact and advances involving unwelcome and explicit sexual overtures.

"There must be a demand or request for sexual favours. There must be a sexually coloured remarks," it added.

Chandran has alleged the woman had raised false allegations against him.
