No bail for Aryan Khan yet, hearing to continue tomorrow
Mumbai/IBNS: Bollywood superstar Shah Rukh Khan's son Aryan Khan, arrested over a drugs-on-cruise case, will have to spend yet another night in the jail as his bail hearing at the Bombay High Court will continue on Thursday.
Aryan's lawyer Mukul Rohatgi said in court that his arrest was a direct infringement of his constitutional rights and that he was never given any reason for his custody.
Aryan has been lodged in jail for 20 days now. He was arrested after drug raids on a cruise ship party on Oct 2 by the Narcotics Control Bureau (NCB).
His defence team once again emphasised on Wednesday that since nothing was found on him, the grounds for both his arrest and denial of bail were flimsy.
"No person who is arrested can be held without being informed of the grounds of arrest and such a person shall have the right to consult a lawyer of his choice," said Mukul Rohatgi, former Attorney General of India.
He referred to Article 22 of the Constitution which guarantees protection against arrest and detention in certain cases.
The NCB has formed the case against Aryan Khan based on WhatsApp chats found on his phone, claiming that they provide enough evidence of his involvement in "illicit drug deals" and his nexus with an international cartel.
"If there is a constitutional infirmity then that cannot be cured by remand," Rohatgi said.
Rohatgi also pointed out that "constitutional issues would arise because none of the others, from whom drugs had been found, had even been arrested" when Aryan was detained.
Aryan's friend Arbaaz Merchant told the court that there was no evidence of any conspiracy or agreement.
