Modi govt's reservation for poor constitutionally valid: Supreme Court

New Delhi/IBNS: The Supreme Court on Monday declared the Centre's 2019 decision to grant 10 percent quota in colleges and government jobs for poor or Economically Weaker Sections (EWS) does not violate the Constitution, media reports said.

The top court judges said the quota does not violate the Constitution considering the capping of 50 percent.

The reservation was launched by the Modi government months before the 2019 General Elections in the backdrop of a string of losses in the state elections.

The decision was almost instantly challenged in the top court.

The judgement was passed by 4:1 in favour of the government. 

Justice Ravindra Bhat, who had dissented, said as quoted by the media, "Economic destitution, economic backwardness is backbone of this amendment and on this account amendment is constitutionally indefeasible.

"However, excluding the classes such as Scheduled Caste/Scheduled Tribes, Other Backward Classes (OBC) is not constitutionally permissible."
