Kulbhushan Jadhav trial: India win appeal as ICJ stays hanging order

New Delhi, May 10 (IBNS): India on Wednesday tasted a massive diplomatic win over its neighbour Pakistan as the International Court of Justice ruled in favour of the former while staying a hanging order of Kulbhushan Jadhav, an alleged Indian 'spy', by the latter, reports said.

India appealed to the ICJ following Jadhav's death sentence by Pakistan, which they issued citing the latter as an Indian spy.

Jadhav, a retired naval officer, was arrested by Pakistan last year.

Found guilty of 'spying', he was given a death sentence by Field General Court Martial in Pakistan last month.

Meanwhile, India acknowledged Jadhav as a former naval officer, but denied his role as a spy.

While India in its defence said that Jadhav was kidnapped from Iran, the Pakistan Army said they arrested the former naval officer from Balochistan on Mar 3, 2016.

"Referring to 'the extreme gravity and immediacy of the threat that authorities in Pakistan will execute an Indian citizen in violation of obligations Pakistan owes to India', India urges the Court to deliver an order indicating provisional measures immediately, 'without waiting for an oral hearing'," India's appeal to the ICJ read.

Pakistan has however charged Jadhav with multiple terrorist attacks, including sponsoring IED attacks on several occasions.

Senior Indian advocate Harish Salve is representing India before ICJ pertaining to the Kulbhushan Jadhav trial.
