CBI moves SC against 12-year-old verdict cancelling Bofors case
New Delhi, Feb 2 (IBNS) : The Central Bureau of Investigation (CBI) on Friday filed an appeal in the Supreme Court against a 12-year-old order of the high court that closed case against the UK-based business magnates Hinduja brothers, and the Swedish firm, in the Rs. 64-crore Bofors case.
According to media reports, though Attorney General of India K K Venugopal had initially opposed filing an appeal in the case, the investigation agency moved ahead on the basis of new evidence after receiving a verbal permission.
Currently there is also an appeal filed by advocate and BJP memer Ajay Agarwal which is pending in the Supreme Court.
Ajay Agarwal urged the AG to direct the CBI to file an affidavit immediately in the Bofors case with all necessary documents.
However, Venugopal had advised CBI to remain only a respondent in the case on the ground a separate petition by the agency would lead to it its dismissal and it would prejudcie the case.
But media reports said that top agency officers had told a parliamentary panel recently that they had the evidence to back up their petition.
The CBI had on January 22, 1990, registered a First Information Report (FIR) for alleged criminal conspiracy, cheating and forgery under the Indian Penal Code (IPC), and sections of the Prevention of Corruption Act, 1988, against Martin Ardbo, then president of Swedish arms manufacturer Bofors AB, alleged middleman Win Chadha, and the Hindujas.
