SC declines Cong request to cross-check Gujarat EVM votes

New Delhi, Dec 15 (IBNS) : The Supreme Court on Friday declined the Congress’ request to direct the Election Commission to match the VVPAT paper trail with the results from at least 20 percent EVMs used across the state during the recently held Assembly elections, media reports said.

“We can’t substitute the decision of the Election Commission unless you demonstrate that the poll panel’s decision is either arbitrary or not in accordance with the law,” said a bench of Chief Justice Dipak Misra, Justice A.M. Khanwilkar and Justice D.Y. Chandrachud.

The Congress in Gujarat made the request to check tampering  after exit polls on TV channels suggested that the BJP is poised for a thumping victory in Himachal Pradesh defeating the ruling Congress and is set to retain power for the sixth consecutive term in Gujarat.
