'You also committed an offence by having sex outside marriage': Supreme Court slams woman who accused partner of rape

New Delhi/IBNS: The Supreme Court on Thursday came down heavily upon a woman who appealed for the cancellation of an anticipatory bail granted to a man whom she accused of rape on the promise of marriage, media reports said.

The top court upheld the anticipatory bail which was granted to the man.

A bench of Justices M M Sundresh and N Kotiswar Singh told the woman that she too had committed an offence by having a physical relationship with a man outside her marriage and warned her of prosecution.

"You are a married woman and you have two children. You are a mature person, and you understand the relationship that you were building outside marriage," the top court said as quoted by NDTV.

When the woman's counsel told the court that the man called her to the hotel repeatedly for intimate acts, the bench said as quoted by the broadcaster, "Why did you go to the hotels repeatedly on his request? You very well understand that you also have committed an offence by having a sexual relationship outside the marriage."

The woman and the man started having an affair in 2016 after they met over social media.

The woman alleged that she had divorced her husband under pressure from the man. But after divorce, the man refused to marry her.

Angered by the refusal, the woman filed a complaint with the Bihar Police alleging she was sexually exploited by the man on the promise of marriage.
