Lawmakers can practice as advocates, rules Supreme Court

New Delhi, Sept 25 (IBNS): The Supreme Court on Tuesday dismissed a plea seeking to ban lawmakers from practicising as advocates, media reports said.

The top court said the Bar Council of India rules do not prohibit lawmakers from practicing as advocates.

A bench of Chief Justice of India Dipak Misra and Justices AM Khanwilkar and DY Chandrachud was hearing the plea filed Bharatiya Janata Party (BJP) leader and advocate Ashiwini Upadhyay.

Upadhyay was seeking to ban lawmakers from practicing inside court during the tenure of their legislatures.

Advocate Shekhar Naphade, who had appeared for Upadhyay, argued saying lawmakers draw salary from public exchequer and a salaried employee is barred from practising in courts by the Bar Council.

Replying to advocate Naphade, the bench said an employment has a master-servant relationship. But a Member of Parliament (MP) is a not a servant of the Government of India.
