Guj riots: Zakiya loses right to file petition

Ahmedabad, Nov 27 (IBNS): A Gujarat court on Tuesday said 2002 Gujarat riots victim Zakiya Jafri has lost the right to file a protest petition against the closure report of the Special Investigation Team (SIT) that gave a clean chit to Gujarat Chief Minister Narendra Modi, due to lapse of time.

A metropolitan court in Ahmedabad said Jafri, whose husband and Congress leader Ehsan Jafri was burnt to death in the killings in 2002, failed to file the petition despite repeated orders.

Jafri's lawyer, however, said that she had earlier informed the court that she had sought some clarification from the Supreme Court and needed more time to file the petition.

Jafri's lawyer said the order given by the court on Tuesday will be challenged in the apex court.

The SIT report in the 2002 riots cases concerning the Gulbarg Society killings did not find any prosecutable evidence against Modi or 61 other accused.

Jafri, the main petitioner in the Gulbarg Housing Society case, earlier said the Supreme Court appointed SIT gave her an incomplete copy of its closure report on the 2002 massacre.

She alleged around 20 pages of the closure report are missing from the copy that was handed over to her on May 7.

An Ahmedabad court in April directed Zakiya should be given within a month a copy of the final report of the SIT on the Gulbarg Housing Society massacre in which Ehsan Jafri was burnt to death.

The SIT report is a closure report on the riots.

Refusing to take a position on the merits of the case, the Supreme Court had last year instead directed the SIT to submit a final report to a trial court that it said should study the evidence and charges against Modi.

The infamous Gujarat riots of 2002 left hundreds of Muslims dead, injured and tortured and came as a blot in the Bharatiya Janata Party (BJP) rule in the state.

The riots followed an incident of train burning in Godhra in which Hindus returning from Ayodhya were killed by a Muslim mob.
