HC terms Assam Min’s election void

Guwahati, July 21 (IBNS): The Gauhati High Court on Wednesday declared the election of Assam Minister Akon Bora void, more than four years after Bora was elected as a state legislator.
Justice IA Ansari, hearing a case filed by defeated candidate Atul Bora challenging Akon Bora’s election, ruled that Akon Bora’s election was void as votes polled in two booths were not counted before announcing results in the 2006 state Assembly polls.
The judge also ordered repelling in the two booths.
Welcoming the verdict, Atul Bora said Akon Bora must immediately step down from his legislator’s seat.
Akon Bora of the Congress was declared winner over Atul Bora by a margin of 853 votes from Dispur LAC in the 2006 Assembly election. Akon Bora is now the state Social Welfare minister.
Atul Bora, in his petition, had claimed that 2160 votes polled in booth number 164 and 193 could not be counted as the Electronic Voting Machines (EVMs) developed some technical snags.
Though he had repeatedly pointed to the returning officer that votes of those two booths were yet to be counted, the officer had declared Akon Bora winner.
“If the votes had been counted, the result could have been different,” Atul Bora, a former minister, said.
He had contested as a Trinamool Gana Parishad (TGP) candidate, a party he had floated after breaking away from his parent party Asom Gana Parishad (AGP). He has since then returned to AGP fold.
